These terms govern the use and licensing of all software modules, API endpoints, and digital services delivered via mond.tv.
Section 2a One-Time Purchase & Perpetual License (Download)
(1) Upon purchasing a one-time module download, the licensee receives a perpetual, non-exclusive license to operate the acquired software version on the agreed infrastructure.
(2) Source code is inspectable and modifiable under the MOND architecture standards. Subsequent major updates or live cloud feeds are not included unless expressly agreed.
Section 2b Software-as-a-Service (SaaS) & Update Subscription
(1) Under an active subscription (Love-as-a-Service, Live API feeds), users receive continuous Love updates, interface patches, and cloud sync services during the contractual term.
(2) Subscriptions renew automatically for the selected billing period and can be terminated at the end of the term. Upon termination, live API access ceases.
Section 2c Payment Terms & Default
(1) Fees are due in advance via selected payment providers (e.g., Stripe, PayPal).
(2) In the event of late payment, we reserve the right to temporarily suspend automated API access until outstanding balances are settled.
Section 3 Third-Party Interfaces & APIs
No liability is assumed for interruptions, modifications, or outages of third-party APIs (e.g., marketplaces, payment processors, or cloud AI providers) absent intentional misconduct or gross negligence.
Section 4 Limitation of Liability
Liability is unlimited in cases of intent or gross negligence. For slight negligence, liability is limited to the breach of material contractual obligations (cardinal duties) and foreseeable damages typical to the contract.
Section 5 Governing Law & Jurisdiction
The laws of the Federal Republic of Germany apply. Place of jurisdiction for all disputes arising from this contractual relationship is Berlin, to the extent permitted by law.
